Seller Donation Fund Attestation
Version: 2026-10-v2
Last Updated: October 20, 2026
Effective Date: October 20, 2026
A Seller must accept this attestation before Artos activates a Seller Donation Fund for its shop. It supplements the Terms of Service, including Section 5.12 (Seller Donation Funds). If this attestation and the Terms conflict, the Terms control.
By accepting this attestation, the Seller, and the person accepting it on the Seller's behalf, confirms each of the following:
- Authority. I am authorized to accept this attestation for the Seller and to bind the Seller to it.
- Accurate description. The fund's name, description, and any campaign messages accurately describe who or what the donations support, how they will be used, and what share of each donation goes to that purpose. I will update the description promptly if any of that changes.
- Use as described. The Seller will use donations only as described at the time each donation is made. If the Seller cannot do so, it will pause the fund, stop accepting donations, and give donors a clear explanation.
- The Seller receives the donation. Donations are paid to the Seller through its connected payment account. Artos is not a charity, fundraiser, trustee, escrow agent, or recipient of donations and does not verify how donations are used.
- Laws and registrations. The Seller is solely responsible for complying with all laws that apply to accepting and using donations, including charitable-solicitation and fundraising registration, consumer-protection, tax, and reporting laws, in every place where it solicits or receives donations.
- No tax-deductibility claim unless Artos verifies it. A donation is described as tax-deductible only after Artos has verified that the organization receiving the fund is a 501(c)(3) organization. Until then, Artos tells donors that the gift is not tax-deductible, and the Seller will not state or suggest otherwise, in the fund description, campaign messages, or anywhere else, or issue a charitable receipt for a donation. If Artos verifies the organization, the Seller confirms that the organization owns the Seller's connected payment account, that the fund is not earmarked for specific named individuals, and that the organization is responsible for the written acknowledgments the law requires, which Artos sends on its behalf as described in item 7. The Seller will tell Artos promptly if any of that changes. Artos does not issue tax receipts in its own name.
- Donor acknowledgments for a verified organization. If Artos has verified the organization, the Seller authorizes Artos to send each donor a written acknowledgment of the donation in the organization's name, showing its legal name and EIN, the donation amount and date, and that no goods or services were provided in exchange for the donation, and to send a corrected acknowledgment if the donation is later refunded, charged back, or restored after a dispute. The Seller confirms that each acknowledgment is accurate, including that the donor receives nothing in exchange for the donation apart from any items bought as a separate purchase in the same checkout. The organization keeps its own records of the donations it receives and will tell Artos promptly if anything in an acknowledgment would be inaccurate, or if its status, legal name, or EIN changes.
- Records and donor questions. The Seller will keep accurate records of donations received and how they were used, and will answer donor questions promptly and honestly.
- Disputes and chargebacks. The Seller bears the full amount of any donation that is disputed, charged back, or reversed, together with any related fees, and authorizes Artos to recover those amounts as permitted by the Terms.
- Non-refundable terms. The Seller will not promise donors refunds that conflict with the Terms, and will honor any refund required by law.
- Artos controls. Artos may review the fund, request information about how donations are used, and pause, remove, or reverse the fund or related donations, or withhold related payouts where permitted by law, for misleading descriptions, misuse, policy violations, or legal risk.
- Changes to this attestation. Artos may publish a new version of this attestation. A fund may need to be accepted again under a new version before it can remain active.
